Court orders parties to maintain status-quo over taken over of public property

A Kano state high court has directed parties involved in the controversial Kofar-Wambai hospital to maintain status-quo pending the hearing and determination of the court.

The exparte order, granted by Justice Maryam Ahmed Sabo of court 16, Miller road, also directed that hearing notice and all the processes on the suit are to be serve on the defendants in due cause in the interest of justice.

The exparte application dated 12th December, 2022, was filed by the plaintiff, one Alh. Abba Kwata K/Wambai and 12 others, against Kano state government and two others, over an attempted plan by the defendants to take over Kofar-Wambai hospital in the municipality.

According to the suit no: K/MI 606/2022, ” the Ex-parte Application dated 12th day of December, 2022 filed by counsel for the Applicants accompanied by a 25 paragrapis affidavit duly deposed to by one Salisu Ibrahim of Yan Awaki, Kofar Wambai, Municipal Local Government, Kano State as well as a written address in support of the application; and after hearing Barrister Badamasi Suleiman,  counsel for the applicants, it is hereby ordered as follows:

“That the parties for now are hereby ordered to maintain the present position Status Quo pending the adjourned date fixed for hearing of the
application. Also, that the Hearing Notice and all the processes to be serve on the Defendants/Respondents in due cause in the interest of justice”.

Similarly, Justice Yusuf Ubale Muhammad of state high court has granted an order of interim injunction, restraining ministry of education and five other defendants, from taken over Kwakwachi secondary school in Kano metropolis.

The court also directed  all parties involved to stay action on the attempted take over of the property by government pending and determination of the originating summons.

The court further directed that all other process in the suit served on the all the defendants in good term and before next adjourned date.

The court gave the order upon an  exparte application, by counsel to the Applicants, Barrister Bashir Yusuf Muhammad Tudun Wuzirci.

The applicants, Nura Salisu Fagge and four others are challenging the percieved action of the defendants, include the ministry of education, Kano state Urban Planning and Development Authority, Kano state Bureau for Land, Kano state government and Attorney General of Kano state.

When contacted for inquiry, Kano state Attorney General and Commissioner for Justice, Barrister Musa A. Lawan refuted knowledge of any exparte order as well as purported action of taken over of any public property.

The Attorney General insisted that his office has not received processes from any party relating to the case in question.

The case is adjourned to 19th January 2023 for hearing of the motion on notice.
