2023 : Again, Court Adjourns Judgement On Kano PDP Legal Tussle

The much awaited ruling on Kano Peoples Democratic Party (PDP) Gubernatorial candidate again suffered adjournments for the second time on Monday.

At the resumed hearing today, interested parties were informed that the judgement will be delivered via Zoom which was later adjourned to next Thursday, December 22nd.

Justice Watch News gathered that Alhaji Muhammad Abacha had via Originating Summon approached the court praying it to declare him winner of the Party Primary Election conducted on 25th May, 2022.

Alhaji Muhammad Abacha is also praying the court to restrain the Independent National Electoral Commission (INEC), its officers, agents and privies from further recognising Sadik Aminu Wali or any other person apart from the Gubernatorial Candidate for the PDP in Kano State for 2023 Governorship Elections.

He told the court that he scored the total votes cast during the primary election and INEC recognized Sadik Wali as Flag bearer for the party.

Similarly, in another suit instituted by Jafar Sani Bello, challenging both Mohammed Abacha and Sadiq Wali over the alleged ground of qualification in accordance with the provisions of the Nigerian constitution, Electoral Act and PDP constitution.

Jafar Sani Bello, challenging INEC for recognising Sadik Wali as flag for the party, urged the court to joined him as an interested party in a suit he instituted and Wali was however joined.

Dissatisfied with the court decision, Sadiq Wali approached the court of appeal asking it to nullify the Federal high court rulling.

The Court of Appeal, consequently upheld that the Federal High Court lacks jurisdiction to hear the matter as such Wali should not be joined as party in the suit.

Justice Watch News recalls that when the case resumed before federal high court on 8th December 2022, the trial Judge fixed 19th December for rulling on Court of Appeal judgement against his decision.

Similarly when the two cases resumed today, the parties were informed that the judgement will be delivered via Zoom and were later adjourned to 22nd of December, 2022.
