Kano PDP Guber Election: Court Fixes January 19 to Decide On Complicated Appeal, In Abacha Vs Wali Case

A Federal High Court sitting in Kano, presided over by Justice A.M Liman, has set aside 19th January, 2022 for judgement in a complicated Appeal Court Judgement that says Muhammad Sadiq Wali was not a party in the ongoing legal tussles between him and Muhammad Sani Abacha, over the People’s Democratic Party PDP Gubernatorial Primary Election in Kano.

The Court had earlier set aside 8th December, 2022 for judgement in the case that bothered on the PDP Gubernatorial Primary Election which was conducted in parallels between Muhammad Sani Abacha and Sadiq Wali with both Parties claiming victory.

However when the Judge resumed on Thursday for judgement, he announced that there was a submission of additional authority in the matter, brought by the Counsel to Sadiq Muhammad Wali, which Counsel to Muhammad Abacha denied knowledge of

Justice A. m Liman said the additional authority was that of a Court of Appeal Judgement which upheld is that his court lacks jurisdiction in the matter because a Court of Appeal had rules that Sadiq Muhammad Wali should be removed from the case before the Court because he is not a party to the suit.

However, Counsel to Muhammad Abacha, Reuben Atabor, SAN argued that the Appeal upon which Court of Appeal rules was not decided by the Federal High Court hearing the matter and as such there was nothing to ride on.

As a heated argument ensued between Counsel on the issues of Court of Appeal, Justice AM Liman, postponed judgement on the originating summons and adjourned to 19th January, 2022 to decide on the Appeal Court Judgement.

In an originating summon, Alhaji Muhammad Abacha is praying the court to declare him winner of the primary election conducted by Peoples Democratic Party, (PDP) in Kano, having satisfied with the requirements of the Electoral Act 2022 (as amended) and scored the highest number of the total votes cast in the election held on 25th May, 2022.
