The violence against persons prohibition law stipulates death penalty for rape convicts who infect their victims with HIV/AIDS.
The Jigawa State House of Assembly passed the law to eliminate and prohibit All forms of Violence Against Persons and to provide maximum protection and effective remedies for victims and punishment of offenders and for related matters.
Jigawa State Violence Against Persons Prohibition Law (VAPP LAW)
RAPE:- The offence of rape is committed where a person intentionally penetrates the vigina, anus or mouth of another with any part of his body or anything else; and
a. Without consent
b. The consent was obtained by force, misrepresentation or intoxication
c. With or without consent where victim is less than 17yrs or mentally sick.
Punishment
A person convicted of rape is to be punished with death or life imprisonment.
2. An offender that commits the offence knowing that he/ she is HIV positive is to be punished with death.
The court shall award compensation to the victim of minimum of N500,000.00.
~ Court to also order for the public shaming of convicted offender.
~ A person that attempts to commit rape to be sent to prison for minimum of 14yrs without option of fine.
~ A person that assists, aids or counsels another to commit rape to be punished with death or life imprisonment.
Administering a Substance with Intent.
A person that gives a substance to another in order to stupefy or overpower that person to commit sexual activity with that person to be sent to prison for a minimum of 1yr or to pay fine of a minimum of 20,000.00 or both.
