Tribunal Refuses Datti Yusuf Umar Extension Of Time For List Of Witnesses

The National/State House of Assembly Election Petition Tribunal sitting in Kano has refused Datti Yusuf Umar of NNPP prayers for the extension of time to list additional witnesses and other particulars in the ongoing petition by Musa Ilyasu Kwankwaso of APC.

Ilyasu Kwankwaso is challenging the victory of Datti, (3rd Respondents) and his declaration as a winner of Kura/Madobi/ Garun Malan, held on the March 18.

The 3 man panel tribunal, however reserved ruling until judgement day, regarding the objection raised by Datti, (3rd Respondent) seeking the Tribunal to struck out some listed pharagraphs by the petitioner in his reply to the respondents.

The 3rd Respondent alleged that the petitioner raised fresh issues that were not contained in the petition, urging the tribunal to struckout all the pharagraphs as well as the fresh issue raised their in.

Consquently, the Tribunal said the issues raised by the petitioner were part of his petition, therefore reserved the ruling until final judgement.

Justice Watch News gathered that the Tribunal fixed 3rd July for the commencement of hearing after conclusion of the pre hearing session.

The Tribunal thereafter, presented the pretrial session report.

Counsel to Musa Ilyasu Kwankwaso (Petitioner) Barrister MN Duru said he will present 19 witnesses in 3 days.

On his part, counsel to INEC (1st Respondent), Barrister Abbas Haladu told the court that he will present 3 witnesses in 3 days.

Counsel to the NNPP, (2nd Respondent) Barrister Aminu Shitu, said he will call only one witness in 3 days.

Counsel to Datti Yusuf Umar, (3rd Respondent) Barrister Tahir Ibrahim, assembled 23 witnesses to be taken in 14 days.

Musa Ilyasu Kwankwaso is praying the Tribunal to declare that Datti Yusuf Umar (3rd Respondents) was not qualified to contest the election alleging that he lied on oath while presenting qualification.

He further alleged that the respondent didn’t resigned his position as civil servant the time he contested the election, arguing that has contravened the provision of Electoral Act.

He is also praying the Tribunal to declare him winner of the Kura/Madobi/Garun Mallam election and accordingly return him.
