Theft: Court Orders Student to Spend 6years, in correctional facility

Kano State High Court presided over by Justice Zuwaira Yusuf has convicted and accordingly sentenced one Ibrahim Abubakar ( Voucher) to five years, nine months in correctional centre for commiting theft at various occasions.

Economic and Financial Crimes Commission (EFCC) had arraigned Ibrahim Voucher on 6 count charges bordering on theft.

According to the charge sheet by the Prosecution Counsel, Abubakar conspired with Ibrahim Musa Kofa, Faroukh Sani Musa Sanusi Abdussalam and other accomplices at large taken various sum of money illegally from United Bank For Africa (UBA).

Some of the head count reads : That you Ibrahim Abubakar (Voucher), Ibrahim Musa Kofa in charge, No K/EFCC/2/2022, Faruk Sani in charge No K/EFCC/22/2022, Musa Sani Abdussalam in charge No K/EFCC/24/2022 and others at large on or about 18th December, 2020 within the jurisdiction of this court agreed to do an illegal act to wit you committed a theft and at the same act was done in pursuant of the agreement and you are thereby committed an offence contrary to section 96 and 97 of penal code of Northern Nigeria and punishable under 287.

” That you Ibrahim Abubakar Voucher, committed theft the sum of two million naira by taking it out of possession of UBA through Yetunde Olariyiki Ajayi-Bembe’s account with the UBA and paid into Abba Aliyu’s account domiciled with UBA you are thereby committed an offence contrary to section 283 of penal code and punishable under section 287 of same law.

After reading over the six count charges to Ibrahim, he pleaded guilty and urged the  court to temper justice with mercy.

The Prosecution Counsel, Barrister A.I Arogha told the court that the commission had plea bargain agreement with the convict, praying the court to sentence Ibrahim based on his plea.

When the court asked him weather he agreed with what the prosecution counsel told the court regarding his plea bargain agreement, he answered in affirmative.

Defense counsel, Barrister A.M Bashir prayed the court to sentence the convict with non custodial terms instead of imprisonment.

” My lord, the convict is student and first time offender, he has aged parents, he is remorseful of his action. I pray for you to consider non custodial terms”, he pleaded.

Delivering the judgement, Justice Zuwaira sentenced Ibrahim Abubakar to six months in correctional centre with an option of N30,000 fine in head count one charge.

In count two, the trial judge sentenced the convict to two years in correctional centre with an option of 100,000 fine

She similarly ordered the convict to serve three months in correctional centre with an option of thirty thousand naira fine in count three.

In count four, justice Zuwaira sentenced to he convict to three months with thirty thousand naira option of fine.

She equally convicted the defendant to two years in correctional facility with two hundred naira option of fine in count five.

The court again sentenced the convict to six months with the option of fifty thousand naira fine.

She consquently ordered that all the terms to be run concurrently.
