Removal of Vehicle Plate Number: Court Orders KASTLEA to Compensate Lawyer

A High Court in Kaduna State, has ruled that the Kaduna State Traffic Law Enforcement Authority (KASTLEA) must compensate Barrister Muhammad Danjumma Abubakar, a legal practitioner based in Kano, with a general damages award of N550,000.

The decision was made in response to the removal of his vehicle’s plate number, impounding of the vehicle, and a demand for immediate penalty payment within 24 hours.

In his judgment, the presiding judge,  Justice Edward Andow, upheld that KASTLEA’s action was assuming the power of the courts to the mandatory provided mobile courts, which is inconsistent with the provision of several sections of the Constitution of Federal Republic of Nigeria, 1999.

According to an affidavit of the Applicant, obtained by Justice Watch News, Muhammad Danjumma Abubakar, the legal practitioner, stated that after servicing his vehicle Corolla LE, he embarked on a journey to Ilorin, Kwara State, on December 5th, 2023.

He further explained that upon reaching Kaduna State, the KASTLEA Corps stopped him and demanded his worthiness certificate and valid documents for the vehicle.

After presenting all his valid documents, they found that the brake light was not lit, which is an offense.

They consequently ordered him to pay the fine within 24 hours and removed his vehicle’s plate number.

In a chat with journalists, Barrister Ibrahim Baba, counsel to the applicant, described the judgment as a landmark one.
