Kano State Governorship Election Petition Tribunal on Monday fixed June 23rd for the commencement of hearing on the petition filed by the All Progressives Congress of APC Kano, challenging the declaration Abba Kabir Yusuf of NNPP as the winner of Governorship Election conducted March 18th, 2023.
Justice Watch News recalled that Kabir Yusuf of New Nigeria Peoples Party (NNPP) scored 1,019,602 votes while immediate past Deputy Governor of the state, Dr Nasiru Gawuna, of APC who scored 892,705 votes.
The three Justices panel, led by Justice Oluyemi Akintan Osadebay fixed the date for the hearing after all parties in the petition concluded tendering their documents during the pretrial conference on Monday.
Justice Osadebay, also upheld that the pre-trial reports would be presented to parties, while proper hearing would begin on June 23.
In a 5-Volume Petition, APC is praying the tribunal to declare that Abba Yusuf is not qualified to contest the election, alleging that his name was not being in the list of of NNPP members sent to INEC.
The Petitioner is further praying the tribunal to declare that NNPP did not win the election with the majority of lawful votes, alleging that some of the votes cast for them were invalid and if removed from their scores, APC will have the highest number of votes.
However in his response, lead counsel to Engineer Abba Kabir Yusuf Adegboyega Awomolo, SAN described the petiton of APC as dead on arrival, explaining that he has assembled over 400 witnesses to defend the respondents’ victory.
Awomolo urged the tribunal to dismiss the petition, as he posited that APC lacks locus to challenge the victory of Kabir Yusuf.
