Defamation against Ganduje, Garo, Assembly: Kano-based Radio Political Supporter Docked

One Damina Ali Gwarzo, a Kano-based Radio Political Supporter has been docked before a Kano State Magistrate Court over the allegation of defaming Personality of Kano State Governor, Dr. Abdullahi Umar Ganduje, Kano State, Commissioner for Local Government, Murtala Sule Garo and Members, Kano State House of Assembly.

According to the First Information Report, Damina Ali, during a 1 hour Radio Programme in one of the Radio Station in Kano alleged to have defamed the personality of kano State Governor, Kano State Commissioner for Local Government, Murtala Sule Garo and Members of Kano State House of Assembly where he described them as Rubber stamp

Acccording to the Report, the action of the defendant contravene sections 144, 392, 393 and 397 of Penal Code respectively.

Justice Watch News gathered that the Kano Northern Youth Forum, an NGO, sent a formal complaint to Kano State Commissioner of Police over the alleged 1hour Radio Programme where Damina Alleged to had committed the offense bondering on Defamation of Character, Injurious Falsehood, Criminal Intimidation and Inciting Public disturbances.

Thereafter, the Defense Counsel, Barrister Yahuza Nura applied for bail in favour of his client, pursuant to section 35 sub 6 of the Constitution of Federal Republic of Nigeria, 1999 as amended and sections 168 and 172 of Adminstration of Criminal Justice Law, (ACJL) of Kano State 2019.

The Counsel said his client if admitted to bail will provide reasonable sureties who will stand for him.

In his response Prosecution Counsel From the Ministry for Justice, Barrister Garzali Maigari Bichi said bail is the descrational power of the court praying the court to admit the defendant on Protective Remand for his safety.

He argued that the alleged offences committed by the defendant may cause breach of public peace if admitted.

In his ruling, Senior Magistrate Gabari refused to admit Damina Ali Gwarzo to bail and ordered the defendant to be remanded in Correctional Centre and  adjourned the case to 18th of November, 2021 for further mention.
