Kano State Magistrate Court Number 9 presided over by chief Magistrate Farida Rabi,u Danbaffa has discharged and acquitted Anas Umar Sheshe and 8 others who were alledged to have stabbed one Aliyu Isa to death.
Sani Yahaya a local security operative in Kano Metropolis reported to Jakara Divisional Police Station that while he and other 10 Volunteer Security operatives on patrol found out that unknown persons stabbed Aliyu thereby inflicted serious injury on several parts of his body and 2 persons sighted wearing facemask and eventually took to their heels with their identity not established.
Other defendants discharged in the case included Abubakar Auwalu, Ibrahim Aminu, Dahiru Sabo, Muhd Tijjani and Abubakar Aminu.
All the Defendants pleaded not guilty of culpable homicide punishable with death under section 221 slammed against them
When the case came up today for further mention, State Counsel Barrister B.S Farukh who held the brief of Amina Aliyu from the Ministry of the State for Justice, presented before the court a legal advise which was signed by Umar Yakubu on behalf of Attorney General of the State.
Reading over the Legal Advise, Chief Magistrate Farida Rabi,u discharged and quashed the culpable homicide charge levelled against All the defendants.
” There was however a contradictory statements by the complaint and Chief Imam of community central mosque who testified before the State Criminal Investigation Department, that they were not recognized the Defendants having sighted wearing facemask”
” They Identified one Aku and Musa Arma Ya,u who are now at large as the prime suspects and non of the 8 defendants before the court were mentioned”
” The culpable homicide charge against 8 Defendants are hereby terminated for lack of evidence and proof and court decision is under section 371(1) of ACJL 2017″
” That absence of Medical Report attached to the Case Diary is fatal to the case”
” There is no evidence linking the 8 defendants with the case” She ruled.
Chief Magistrate Farida, consequently, ordered police to intensified efforts to arrest the real culprits.
After the proceeding, Barrister Sanusi Lawan Fandubu commended Attorney General of Kano State
