Building of Corner shops at K/Wambai Market: Court Grants Leave To Defendants

The Kano State High Court presided over by Justice Dije Aboki has granted leave to Kano State Bureau for Land Management and 4 other defendants respond to the motion out of time by Applicants ,Alhaji Radi Hassan and 5 others who prayed the court to perpetually restrain all the defendants from tempering with the structure or further constructing any shop at Babban Layi in Kofar Wambai Market.

When the case resumed on Wednesday for the hearing of motion on notice of interlocutory injunction, the Counsel to Kano State Government and other defendants, Barrister MN Duru filed a Counter Affidavit seeking the court to allow him respond to the motion of Applicants out of time.

In her ruling, Justice Aboki observed that the Defendants didn’t paid the default fees by counsel to Bureau for Land Management to warrant court grant leave and extend their time to respond.

Her words: ” I hereby order
for the extension of time as prayed by counsel to the Defendants but subject to the settlement of default charges”.

Court Remands 3 Men for Allegedly Stealing 10 Phones, £10

In his response to the ruling Barrister MN Duru told court that the Defendants will calculate all the default charges and offset  after today’s proceeding.

Justice Aboki consquently adjourned the case to 22nd September, 2021 for hearing of motion on notice.

Justice Watch News learnt that the Defendants in the case were: Kano State Bureau for Land Management,
Kano State Government, Office of the Attorney General and Commissioner for Justice, and a Private Company.
