The Applicant, through his counsel, Barrister Christopher Oshomeghen prayed the court to grant his application on the ground that the State Executives of APC didn’t fulfill the constitutional requirements mandated by the Party before contesting their positions.

The counsel argued that the action of Abdullahi Abbas and his secretary Ibrahim Sarina contravened the provisions and rules guiding the party, for not resigning their positions as Caretaker Committee before contesting the substantive positions, during the state congress held in October, 2021.

In his submission, counsel to Abdullahi Abbas, Barrister M.N Duru, filed a preliminary objection, praying the court to dismiss the suit, stressing that the court lacks jurisdiction to entertain the case.

Mr. Duru urged the court to refuse all the prayers by the applicant and uphold the supreme court judgement which affirmed the election of Abdullahi Abbas as APC Chairman in Kano.
