Abduljabbar: Court fixes March 31 for Ruling on Bail Application

An Upper Shari’a Court sitting in Kano, on Thursday, fixed March 31, for ruling on bail application by counsel to Kano cleric, Sheikh Abduljabbar Nasiru-Kabara, in the ongoing alleged blasphemy trial.

The Judge Malam Ibrahim Sarki-Yola, adjourned the matter until March 31 for ruling on bail application and continuation of defense

The defense counsel, Mr Ambali Obomeileh-Muhammad, SAN,who was represented by Barr. Auwal Muhammmad, again made a bail application for the 3rd times, under section 36 (6) of constitution of Federal Republic of Nigeria 1999 as amended.

The prosecution counsel, Mr Suraj Sa’eda SAN, objected the bail application under section 171 of the Kano state ACJL 2019.

“A person standing trial on capital offence punishable to death shall not be granted bail”

Earlier, Led in evidence by defence counsel, Obomeileh-Muhammad, the defendant told the court that the PW1 and PW4 in their testimony did not know the meaning of the hadith.

” In my preachings I was only trying to protect Prophet Muhammad (PBUH) from the comments against him on his with Nana Safiyya,” he said.

The defendant also narrated that he only translated what he saw in the Hadith. It is not his interpretation.

“Qulumul hadith page 223 says if hadith is more than one and are many, you can preach on it at a time if it is base on meaning.

“I am ready to present an audio of my preachings which I was protecting Prophet Muhammad(PBUH) against the comments”

The cleric tendered a total of 54 books exhibits which include: At tauhihul fatahul bari, Almuhadisu Alfasil Banul Rawawil Wali,Sunannun Darumi,Jami’u Ilmi,Tauhiful Abkar,Anannakatu Almukaddimatu IBM Salah, Al Gaya and 47.

The defendant was alleged to have made a blasphemous comment against Prophet Muhammad during his preaching.
