Yusuf Maitama Sule Versity Residential Plots: Court Refuses Grant of Ex-parte Application

One Alhaji Wurji Muhammmad and 64 other Applicants have dragged Kano State Government and 3 other Respondents before
Kano State High Court, presided over by Justice Maryam Sabo, seeking the court to restrain the defendants from tempering with their residential plots lying and situated at Northwest University ( now Yusuf Maitama Sule University) permanent site, covered by plan Number TP/UDB/192.

Justice Watch, recalled that earlier on the 25th November, 2021 the Applicants through their counsel by means of ex-parte application, prayed the court to restrain all the defendants from tempering with their ownership of residential plots by way of re – allocating same to other persons.

In her ruling, Justice Maryam refused to grant the ex-parte application and ordered hearing notice to be served on all defendants in the suit for the interest of justice.

When the case resumed today for hearing, neither the respondents nor their counsel attended the sitting which was slated for hearing.

However, in his submission counsel to the Applicants Barrister Hussani Rabiu informed the court that the matter was fixed today to move his application on notice.

The Counsel maintained that the Defense counsel called and informed him that the Respondents were served with motion papers yesterday and they equally need time to file their court processes.

Upon hearing the submission of Applicants counsel, Justice Maryam Sabo adjourned the case 21st December, 2021 to enable all the Respondents file their court processes.

Similarly, Justice Watch gathered that the 4 Respondents in the case include: Executive Governor of Kano State as First Respondent, Attorney General of Kano State as second Respondent, Kano State Bureau for Land Management, third Respondent and Unknown Person(s) as fourth defendant.

The Applicants are praying an interim injuction seeking the court to restrain Kano State Bureau for Land Management (4th defendant) from further act of constructing and building exercise on the portion of the their plots alleged to had illegally encroached by the fourth defendant, pending the hearing of motion on notice.
