League of Lawyers for Support and Sensitization of Consumers Right in Nigeria, (LELASSCORN) an NGO, has sued National Agency For Food and Drug Adminstration and Control (NAFDAC) before Federal High Court Kano, over alleged of non disclosure of information and record of its investigation on sale, distribution and consumption of fake and adulterated flavoured drink in Kano it demanded through a letter.
In 13 Pharagraphs affidavit in Support of Originated Motion, dated 15th October, 2021 the Applicant said it brought the application pursuant to order 34 rules 5 (1) and (2) of Federal High Court Civil Procedure Rules 2009 and Section 1, 20, 25 of Freedom of Information Act 2021, Laws of the Federal of Nigeria.
The group of Lawyers is praying the court to declare that the act of NAFDAC for refusing to to give the them access to information and record of its Investigation on the sale, distribution and consumption of fake adulterated flavoured drink it demanded through a letter dated 15th September, 2021 eventhought it acknowledged on the 16th September, 2021 is a clear violation of the provisions of Freedom of Information Act, 2011.
The Applicant explained that, sometimes in the month of March, 2021 some fake and adulterated flavoured drinks were sold to the innocent people of Kano, by unknown individuals.
The Group of Lawyers, argued that, as a result of sale, distribution and consumption of fake and adulterated flavoured many people lost their lives and many others hospitalized.
In the affidavits, the Applicant stated that sometimes in April, 2021, the NAFDAC Director General, Professor Mojisola Adeyeye issued a public statement claiming to have captured the culprits behind the act and submitted its report to Kano State Government.
LELASSCORN is praying the court to compel NAFDAC to issue with it Information and record of the Investigations it conducted on the incident.
