Kano State High Court presided by Justice Abdu Maiwada Abubakar has ordered one Ohuimwen Eghosa to restitute the sum of N500,000 to Muhd Abdullahi Kofar Mata in addition with 3 months in Correctional Facility or to pay the option of N50,000 for illegally taking the sum of N500,000 from the Bank Account of Complainant domicile at UBA.
Arrainging the defendant before the court, prosecution counsel from Economic and Financial Crime Commission EFCC Micheal Ojo told the court that Eghosa committed the offence on the 9th June, 2021.
The charge sheet by EFCC presented to the Defendant in court reads
” That you Ohiumwen Oghosa on the 9th June, 2021 at Kano within the jurisdiction of this court of kano state committed theft to the tune of five hundred thousand naira, by taking it out from the possession of Muhd Abdullahi Kofar Mata from his bank account domicile with UBA. You are thereby committed offence contrary to section 286 and punishable under section 287 of penal code,”
Reading over the charge sheet to Eghosa he pleaded guilty and urged the court to temper justice with mercy.
Consequently, the prosecution counsel Barrister Michael Ojo informed the court that the defendant has through his counsel sought for plea bargain to restitute the amount he theft from the Account of Kofar Mata and that in accordance with section 272 of Administration of Criminal Justice Law 2019 of kano state.
” That the Nominal Complainant has considered the general nature and circumstances of this case, and in the interest of justice and public interest and the need to avoid delay of justice we obliged the agreement of plea bargain”.
In his ruling Justice Maiwada maintained that in view of the defendant’s admission of his offence he was convicted and accordingly sentenced to pay the sum of N500,000 the actual amount he benefited from the crime.
Justice Maiwada similarly ordered Egosha to be jailed to 3 months in Correctional Facility or to pay the option of N50,000.
