Kano State High Court Presided over by Justice Dije Aboki has convicted one Salisu Muhammad Yakasai to death by hanging for stabbing his colleague Mujtaba Musa in the chest over football match argument.
Delivering the Judgement, Justice Aboki said the prosecution counsel Barrister Lamido Abba Soron dinki has proved the ingredients of culpable homicide against the defendant.
According to the charge sheet preferred against Salisu Yakasai, stated that the on 2nd March, 2019, the Defendant caused the death of Mustapha Musa by stabbing him twice in the chest with a sharp knife.
” That you Salisu Muhammad Yakasai Male, adult of Yakasai quarters, Kano Municipal Local Government Area, Kano State, on or about 2nd, March, 2019 at about 23:20hrs, at Yakasai Quarters Kano, within kano judicial division, did commit culpable homicide punishable with death, in that you caused the death of one Mujtapha Musa by stabbing him in the chest twice with a sharp knife with the intention of causing his death and thereby committing an offence punishable under section 221(a) of the penal code.
Earlier, Prosecution Counsel, Barrister Lamido Abba Soron Dinki presented 4 witnesses including eyewitnesses who testified against the defendant.
While Defense Counsel Dr. Sani Salihu called 3 witnesses including Yakasai who defended himself.
In his testimony before the court, an eye witness Suleiman Muhammad of Yakasai Quarters stated that after they had finished watching football match both decease and the defendant started arguing over the match. His words ” as the argument got heated up, the defendant brought out a knife and stabbed mujtapha in the ankle and chest on their way to hospital the decease died,”
Also in his testimony, another eyewitness, Musbahu Yusuf stated that he was little far away from where the defendant and decease were arguing over a football match that was aired on that night, when he saw the defendant brought out a knife and stabbed the decease in the chest. His words ” I was the one who overpowered Mujtaba and snatched away the knife and took the corpse to Hospital where he was confirmed dead.
In her judgement, Justice Aboki pointed out that the state counsel has discharge the burden of prove against the Mujtaba Musa.
Consequently, Justice Dije Aboki sentenced the defendant to death by hanging.
